LOS ANGELES – American DJ, a manufacturer of lighting, audio and trussing products, has filed suit in the U.S. District Court Central District of California against NSI Audio, Inc., a California company that sells and distributes products under several brand names, including American Vocal and Vertigo. American DJ's legal action is centered on two trademarks recently adopted by NSI: Vertigo for lighting products and American Vocal for audio products. The suit alleges that aside from using product and brand names that were the same or very similar to those used by American DJ, NSI used copyrighted images belonging to American DJ.
The suit, filed on May 13, 2010, seeks monetary rewards and statutory damages. The company is also demanding that NSI cease selling the products in question, remove them from distribution, and destroy all copyrighted images that have been used in the company's marketing and advertising.
